Terms of Service

Welcome to Landia. These Terms of Service ("Terms") govern your access to and use of the Landia service, website, and related software (collectively, the "Service"), operated by Salim MEGANI, entrepreneur individuel registered under the French micro-entreprise regime (SIREN 909 833 691, SIRET 909 833 691 00027, RCS Paris 909 833 691, VAT not applicable under Art. 293 B CGI), with a contact address at Station F, 5 Parvis Alan Turing, 75013 Paris, France ("we", "us", "Landia"). By creating an account or using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Landia, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

Landia is an AI-powered marketing platform designed for Amazon sellers. The Service enables you to generate landing pages, create ad creatives, run media-buying workflows, and track Amazon Attribution and Brand Referral Bonus performance. Features evolve over time and may be modified, added, or removed at our discretion.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use Landia. The Service is intended for professionals, entrepreneurs, and businesses. By using it, you represent that you meet these requirements.

4. Account Registration

You must create an account to use the Service. You agree to:

• Provide accurate, current, and complete information
• Keep your credentials confidential
• Notify us immediately of any unauthorized use of your account
• Be solely responsible for all activity under your account

We may suspend or terminate accounts that violate these Terms or that pose a security or legal risk.

5. Subscription and Payments

Landia is offered on a subscription basis. By subscribing you agree to:

• Pay all applicable fees according to the plan you select
• Provide a valid payment method
• Authorize recurring billing through Stripe until you cancel
• Be responsible for any taxes that may apply

Subscriptions renew automatically at the end of each billing period. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by applicable law.

We may change pricing for future billing periods with at least 30 days' notice.

6. Credits and Usage

Some features consume credits from your plan's monthly allowance. Credit costs per action are displayed in-app and may be updated as the Service evolves. Unused credits do not roll over to the next billing period unless explicitly stated. Credits have no monetary value and cannot be exchanged or refunded.

7. User Content and Ownership

You retain full ownership of the content you create using Landia, including:

• Landing pages generated through the Service
• Email addresses captured via your landing pages
• Ad creatives and copy generated for your products
• Any data and analytics tied to your campaigns

You grant us a limited, non-exclusive, worldwide license to host, store, and process this content solely to operate and improve the Service. We never sell or share your content.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or deceptive purpose
• Violate Amazon's terms of service or any other applicable platform rules
• Promote prohibited products (illegal goods, counterfeits, etc.)
• Reverse-engineer, scrape, or attempt to gain unauthorized access to the Service
• Resell or sublicense the Service without our written consent
• Upload malicious code, spam, or content infringing third-party rights

We may suspend or terminate your access for violations.

9. Amazon Disclaimer

Landia is an independent service. We are NOT affiliated with, endorsed by, or sponsored by Amazon.com, Inc. or any of its subsidiaries. References to Amazon, ASINs, Amazon Attribution, or Brand Referral Bonus are made solely for compatibility purposes.

We do not guarantee any specific outcome, ranking improvement, sales increase, or eligibility for Amazon programs. Your results depend on many factors outside our control, including your product, niche, pricing, and Amazon's own algorithms and policies.

You are solely responsible for ensuring your use of Landia and your external traffic strategy complies with Amazon's terms of service and any other applicable rules.

10. Intellectual Property

The Landia platform, including its software, design, branding, AI models integration, and documentation, is owned by us and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service itself. You may not copy, modify, distribute, or create derivative works of the platform without our prior written consent.

11. Third-Party Services

Landia integrates with third-party services including but not limited to Stripe, Supabase, Vercel, Anthropic, OpenAI, Amazon Advertising, and Amazon Attribution. Your use of these services may be subject to their own terms. We are not responsible for the availability, content, or practices of third-party services.

12. Service Availability and Modifications

We strive to keep Landia available 24/7 but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications without prior notice. We are not liable for any downtime, data loss, or performance issues caused by factors outside our reasonable control.

13. Warranties Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

14. Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill.

15. Indemnification

You agree to indemnify and hold us harmless from any claim, demand, loss, or damages, including reasonable legal fees, arising out of your use of the Service, your content, or your violation of these Terms or any third-party rights, including Amazon's terms of service.

16. Termination

You may stop using and delete your account at any time. We may suspend or terminate your access to the Service if you breach these Terms, fail to pay, or use the Service in a way that harms us, other users, or third parties. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will remain in effect.

17. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute relating to these Terms or the Service shall be submitted to the competent courts of Paris, France, except where mandatory consumer protection rules apply.

18. Changes to these Terms

We may update these Terms from time to time. The latest version will always be available on this page. Significant changes will be notified by email or via the Service. Continued use of Landia after changes take effect constitutes acceptance of the new Terms.
